Moroso 8 quart pan 20607 and correct oil level

I double-checked with Moroso about the oil level, and all they can say is 8 qts plus the filter. I measured 8 quarts of water into the pan and it is at 2-1/4" below the flange. This puts the level above the baffle, and is barely below the rotating assembly.

I carefully marked my installed stick with the pan off at 2-1/4", and it's about 1" above the highest mark on it. Since the stick sits at about 45 degrees, this means that the recommended oil level is about 3/4" higher than the high mark on my aftermarket dip stick.

Doing the math, 6" deep pan, pickup 3/8" off the bottom, I end up with 3-3/8" of oil, statically, over the pickup. If I aim for the top of the dipstick mark, this will give me 2-5/8" available.

Is there any guidance of the acceptability of this reduced level? I'm concerned with the level being too high, oil foaming.

I simply put in 8 quarts- no extra for the filter. After a run the oil is at the very top of the dipstick range.
